Cancellation Policy

  • Cancellations made more than 36 hours before the scheduled booking start time are eligible for a full refund to the original form of payment.
  • Cancellations made within 36 hours of the scheduled booking start time are subject to a 20% cancellation fee. The remaining 80% will be refunded to the original form of payment.
  • To cancel, contact us at book@perfectbeachdaynj.com with your name, booking date, and reason for cancellation. We respond to all inquiries within 4 hours during operating season (Memorial Day through Labor Day).

Booking and Reservations

Booking Process

Reservations must be made through our website, phone, or email. All services are pre-paid in full at time of booking.

Confirmation

Bookings are confirmed only once payment is received and an email confirmation is sent.

Availability

All services and equipment are subject to availability. If we cannot fulfill your request, we will contact you promptly with alternatives.

Rental Items

  • Customers are responsible for proper care and use of all rented equipment during the service period.
  • Equipment must be used only for its intended purpose and in accordance with the Rental Agreement and Rain Policy.
  • In the event of damage or loss, the customer is responsible for repair or replacement costs as outlined in the Rental Agreement.

Customer Conduct

  • All customers must respect the property and facilities provided by PBD.
  • Customers are expected to conduct themselves respectfully toward other guests and staff.
  • Perfect Beach Day NJ does not condone any illegal, harmful, irresponsible, or dangerous behavior.
  • Please follow all local laws and regulations regarding smoking and alcohol.

Safety and Liability

Assumption of Risk & Liability Waiver

Beach activities involve inherent risks, including but not limited to: exposure to sun, wind, and water; uneven terrain; physical activity; and use of beach equipment. By booking or using our services, you voluntarily assume all such risks.

You agree to release, indemnify, and hold harmless Perfect Beach Day NJ LLC, its owners, employees, and contractors from any and all claims, losses, damages, or liability — including third-party claims — arising from: (a) your use of rented equipment; (b) injuries to you, members of your party, or bystanders during the service period; (c) damage to personal property; or (d) any beach conditions beyond our control, including weather, tides, and sand conditions.

This waiver applies to the fullest extent permitted by applicable law. If any provision of this waiver is found unenforceable, the remaining provisions remain in full effect.

Equipment Safety

Customers are responsible for monitoring the safety of the setup throughout the day. If any equipment becomes unstable or weather conditions deteriorate, customers must immediately secure or vacate the setup and notify our team. PBD is not liable for injuries resulting from equipment misuse or failure to follow safety instructions.

Third-Party Injuries

You are responsible for ensuring that all members of your party and any nearby individuals are not endangered by your rented equipment. Perfect Beach Day NJ is not liable for injuries to third parties caused by renter negligence or failure to maintain the setup area.

Age Restrictions

Customers must be at least 18 years of age to book or rent equipment. Minors may use our services only under the direct supervision of a responsible adult who has agreed to these Terms & Conditions.

Multi-Day & Weekly Packages

Multi-day and weekly packages cover consecutive days of service at the same location. The following terms apply to all multi-day bookings:

  • PBD performs a full setup and full breakdown every single day. Customers do not retain or store any equipment overnight — all gear is removed by our crew at the end of each day.
  • Each day is treated as a standalone service. If a day is missed due to weather, the Rain Policy applies to that individual day.
  • Cancellation of a multi-day package more than 36 hours before the first scheduled day receives a full refund. Cancellations within 36 hours of the first day are subject to the standard 20% fee on the total package price.
  • Individual days within an active multi-day package cannot be canceled for a partial refund once the package has begun, except in the case of a weather cancellation handled under the Rain Policy.
  • Multi-day packages are non-transferable to other customers or locations unless approved by PBD in advance.

SMS Communications Consent

1. SMS Consent & Twilio Compliance

Perfect Beach Day NJ's SMS program operates in compliance with the Telephone Consumer Protection Act (TCPA) and all applicable carrier requirements, including those of our SMS provider, Twilio. By opting in, you consent to receive text messages from Perfect Beach Day NJ for booking-related purposes only. SMS opt-in data and phone numbers will not be shared with any third party or affiliate for marketing purposes.

2. Types of SMS Communications

If you have consented to receive text messages from Perfect Beach Day NJ, you may receive messages related to:

  • Booking confirmations and reminders
  • Day-of coordination and location updates
  • Follow-up messages and responses to your inquiries

Example: "Hi, this is a reminder of your Perfect Beach Day NJ booking in Ocean City on Saturday at 9:00am. Reply STOP to opt out."

3. Message Frequency

Message frequency may vary. You may receive up to 2 SMS messages per week related to your booking.

4. Potential Fees

Standard message and data rates may apply depending on your carrier's pricing plan. These fees are charged by your carrier, not by Perfect Beach Day NJ.

5. Opt-In Method

You may opt in to receive SMS messages by checking the SMS consent box on our booking forms. Consent is not a condition of purchase.

6. Opt-Out Method

Reply "STOP" to any SMS message at any time to immediately opt out. You will receive one confirmation message and no further texts. You may also contact us at book@perfectbeachdaynj.com to be removed from our messaging list.

By booking, renting, or using services provided by Perfect Beach Day NJ, you agree to comply with these Terms and Conditions. These terms govern your use of our services and any interactions with PBD.
